06Custom development and automated applications
D&TC develops software, including automated trading and analytical applications, on a custom basis according to the specifications and instructions provided by the client. Where we build or deliver such an application:
- The client directs the design, parameters, and intended use of the application;
- The client is solely responsible for testing, deploying, connecting, monitoring, and operating the application, including any connection to the client’s own brokerage account; and
- D&TC is not responsible for any trades, orders, executions, losses, malfunctions, downtime, data errors, or other outcomes resulting from the client’s deployment or use of any delivered application.
Automated systems can and do fail. Technology, data feeds, connectivity, and brokerage platforms may experience errors, latency, or outages outside our control.
07Third-party data and platforms
The Services may rely on or display data, charts, or content from third parties (for example, market-data providers, charting platforms, Discord, or TradingView). We do not control and are not responsible for the accuracy, completeness, timeliness, or availability of any third-party data or platform.
